Terms and Conditions

In case of conflict between the German and English versions, the German version prevails, as TYG5 is a German sole proprietorship governed by German law.

Important note on scope

These terms govern use of the tyg5.com website and the licensing terms for TYG5 templates. They do not govern the actual purchase contract or payment processing — that is concluded between the buyer and the respective external checkout provider (see § 4). The checkout provider's own terms and withdrawal-right notice apply to the purchase itself.

§ 1 Scope and contracting party

(1) These terms apply to use of the tyg5.com website and to all digital templates ("Templates") purchased via the website or the Framer Marketplace, offered by:

("TYG5" or "Provider")

(2) TYG5 is the provider of the Templates for licensing purposes (§ 3), not the seller for payment-processing purposes. The purchase contract for a Template, and all payment-related matters (invoicing, withdrawal right, payment methods), are concluded between the buyer and the respective checkout provider (§ 4).

(3) These terms apply to both consumers and business buyers, except where expressly differentiated by customer type.

§ 2 Description of services

(1) TYG5 provides digital templates for the Framer website-building platform. A Template consists of a pre-built Framer project structure, accessed via a "Remix link," which the buyer copies into their own Framer account after purchase and then customises freely.

(2) TYG5 assumes no obligation to host, operate, maintain, or further develop any website the buyer builds from a Template. Publishing and operating the customised website is solely the buyer's responsibility.

(3) The Remix link is delivered automatically by the respective checkout provider immediately upon successful payment. TYG5 does not send this link itself.

(4) The feature and service description shown on the product page (Framer Marketplace or tyg5.com) at the time of purchase applies to that Template.

§ 3 Usage rights / licence

(1) Purchase of a Template grants the buyer a simple, non-transferable, non-sublicensable right to use that Template under the separately provided licence terms ("TYG5 Template Licence," see licence terms).

(2) Unless stated otherwise, the standard licence covers use of the Template on one published project (single-site licence). A separate multi-site licence is required for use across multiple projects, once available.

(3) All copyright and other proprietary rights in the Template itself — including its design, structure, and source code — remain with TYG5. The buyer does not acquire ownership of the Template, only the usage right described in paragraph 1.

(4) In particular, the following are not permitted: reselling the Template as such, including in modified form; providing the Template or Remix link to third parties; and using the Template to build an offering that competes with TYG5 Templates.

(5) The full licence terms form part of these terms.

§ 4 Purchase contract, payment processing, and withdrawal right

(1) The purchase contract for a Template is concluded not with TYG5, but with an external payment provider engaged by TYG5, who acts as Merchant of Record and through whose platform the purchase is processed. The currently applicable provider is shown on the relevant product page and during checkout itself.

(2) The checkout provider acts as Merchant of Record and is responsible for: payment processing, invoicing, collection and remittance of applicable sales tax/VAT, and providing and implementing the statutory withdrawal right, including the required consent and disclosure obligations under German law (§ 312d, § 356(5) BGB).

(3) The checkout provider's own terms and withdrawal notice therefore exclusively govern the purchase process, payment methods, invoicing, and the withdrawal right — not these TYG5 terms. The buyer is redirected to the checkout provider's platform before completing the purchase and concludes the contract there.

(4) TYG5 itself never processes the buyer's payment data.

§ 5 Warranty and liability

(1) TYG5 takes reasonable care in creating the Templates but does not warrant that a Template is fully suited to the buyer's specific intended purpose.

(2) TYG5's liability for damages caused by ordinary negligence is excluded, except where such damages arise from breach of a material contractual obligation (cardinal obligation) — one whose fulfilment enables proper performance of the contract in the first place and on whose observance the buyer may regularly rely. Where a material obligation is breached, liability is limited to foreseeable damage typical for this type of contract.

(3) The above limitations do not apply to damages arising from injury to life, body, or health, nor to damages caused by intent or gross negligence.

(4) For damages arising in connection with payment processing, invoicing, or the withdrawal right, only the respective checkout provider is liable (§ 4).

§ 6 Support

(1) TYG5 provides email support for 6 months from the purchase date for setup questions and reported bugs in the Template itself (see licence terms).

(2) Not included: general Framer support, custom design work, or support for changes the buyer has made to the Template themselves.

§ 7 Changes to these terms

TYG5 reserves the right to amend these terms with effect for the future. Material changes will be indicated on tyg5.com.

§ 8 Final provisions

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(2) Where the buyer is a merchant, a legal entity under public law, or a special fund under public law, Hanau is the place of jurisdiction for all disputes arising from this contractual relationship.

(3) Should individual provisions of these terms be or become invalid, the validity of the remaining provisions is not affected.
